　　一是加强涉企行政诉讼和执行监督，依法平等保护产权。依法办理涉企征收补偿、赔偿案件，保护企业财产权益。最高检发布典型案例，指导高质效办好涉企房屋与土地征收、违建拆除、环境资源整治等行政赔偿诉讼监督案件。加强对法院违法执行企业标的、错误适用司法强制措施、超额冻结扣押企业账户资金等执行活动监督，防止企业因不当强制执行陷入生产经营困境。湖南省张家界市检察机关针对法院违法冻结涉案企业财产2.8亿余元的诉讼执行行为，监督法院解除被冻结账户，及时维护企业合法权益。广东省深圳市检察机关通过交通运输领域行政处罚非诉执行类案监督，督促行政机关依法处理64件被法院裁定不准予执行的案件，形成《关于行政处罚执行情况开展检察监督工作的报告》，向市委依法治市办专项报告，促进系统治理。上海、福建等地推动涉案企业合规成果行刑互认，将合规整改作为建议从轻、减轻行政处罚的重要考量因素，以行刑反向衔接助力企业健康发展。

　　二是加大对“小过重罚”等问题的监督。最高检发布涉企行政处罚检察监督典型案例，指导正确适用部门法与行政处罚法，部门法最低处罚明显与违法情节不成比例的情况下，适用《中华人民共和国行政处罚法》相关规定予以校准，推动落实“过罚相当”原则。推广浙江省象山县检察院督促执法机关纠正“小过重罚”大数据模型和江西省赣州市检察院餐饮类行政处罚大数据监督模型，指导各地在“检察护企”专项行动中办理案件200余件，促进“小过重罚”综合治理。凝聚“过罚相当”执法司法共识，推动统一执法监督与行政诉讼法律适用标准。河南省检察院与法院、市场监管部门出台会议纪要，明确食用农产品市场监管法律适用标准。福建省检察院会同法院、市场监管部门、司法行政部门出台会议纪要，统一“三小”食品安全违法行为减轻处罚裁量标准。
